1. Acceptance of Terms

By accessing and using Collectible Loot ("we," "us," "our," or the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our website located at collectibleloot.com and our marketplace services for buying and selling collectible items.

2. Description of Service

Collectible Loot is an online marketplace that connects buyers and sellers of collectible items including but not limited to trading cards, action figures, comics, gaming collectibles, and related merchandise.

We provide the platform and tools for transactions but are not a party to the actual sales between buyers and sellers.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use of your account

4. Seller Requirements

To become a seller on our platform, you must:

• Complete our seller application process and receive approval
• Provide accurate business information and comply with all applicable laws
• Accurately describe all items listed for sale
• Honor all sales and ship items promptly
• Maintain a professional standard of customer service

We reserve the right to suspend or terminate seller accounts that violate these terms or provide poor customer experiences.

5. Prohibited Activities

You may not use our Service to:

• Sell counterfeit, stolen, or illegally obtained items
• Misrepresent the condition, authenticity, or description of items
• Engage in fraudulent activities or money laundering
• Violate any local, state, national, or international law
• Infringe on intellectual property rights
• Harass, abuse, or harm other users
• Spam or send unsolicited communications
• Upload malicious code or attempt to hack the platform

6. Fees and Payments

Our fee structure is designed to be transparent and seller-friendly:

Commission Structure

• Seller Commission: We charge a 5% commission on item sales only (excluding shipping and tax)
• Platform Managed Shipping: We handle all shipping logistics and provide FREE shipping labels to sellers
• No Hidden Fees: No listing fees, no monthly fees, no payment processing fees charged to sellers

Shipping Costs

• Standard Shipping: $8.99 (3-5 business days)
• Expedited Shipping: $12.99 (1-2 business days)
• Overnight Shipping: $19.99 (next business day)
• Alaska & Hawaii Surcharge: 50% additional cost applies to all shipping options due to remote location and carrier costs
• Service Area: United States only (all 50 states excluding territories)
• International Shipping: Not available at this time

Payment Terms

• Sellers receive 95% of item sale price after successful transaction
• Platform retains 5% commission plus shipping revenue to cover operational costs
• Payments to sellers are processed according to our payment schedule
• All transactions are processed securely through Stripe

All fees are subject to change with 30 days' notice. Current fee structures are available in your seller dashboard.

7. Shipping and Delivery

Platform Managed Shipping

Collectible Loot operates a platform-managed shipping system where we handle all shipping logistics, provide shipping labels to sellers at no cost, and maintain consistent service standards.

Seller Responsibilities

• Package items securely and professionally
• Create shipping labels through our platform within 1 business day of order
• Ship items within 2 business days of order placement
• Provide accurate item descriptions and condition assessments
• Maintain current shipping address information in your seller settings

Buyer Protections

• All shipments include tracking and insurance
• Items not as described may be returned for refund
• Damaged items during shipping are covered by insurance
• Platform mediates shipping disputes between buyers and sellers

Service Limitations

• Shipping currently available within the United States only
• Some delivery timeframes may be affected by carrier delays
• Signature confirmation automatically applied to high-value orders
• Platform reserves the right to modify shipping policies with notice

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Collectible Loot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you post, but grant us a license to use, display, and distribute it on our platform.

9. Dispute Resolution

While we provide tools to help resolve disputes between buyers and sellers, we are not obligated to mediate or resolve such disputes. However, we may:

• Provide dispute resolution assistance
• Hold payments in escrow pending resolution
• Remove listings or suspend accounts for policy violations

10. Limitation of Liability

Collectible Loot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for all damages shall not exceed the amount paid by you to us in the twelve (12) months prior to the action giving rise to liability.

11. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

14. Governing Law

These Terms shall be interpreted and governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of Wisconsin.
